Terms of Service

1. Acceptance of terms

By accessing or using Zomimo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Use of the Service

You may use Zomimo only for lawful purposes and in accordance with these terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations • Attempt to gain unauthorised access to any part of the Service • Use the Service to generate content intended to deceive or harm • Share your account credentials with others

3. Account registration

You must create an account to use most features. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at wecare@zomimo.com if you suspect unauthorised access.

4. AI-generated content

Zomimo uses AI to assist in generating content such as parent reports and lesson plans. You acknowledge that:

• AI outputs may contain errors or inaccuracies • You are responsible for reviewing and approving all AI-generated content before sharing it with parents or including it in official records • Zomimo does not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose

5. Content ownership

You retain ownership of all content you create using Zomimo, including the input notes you provide and the final edited outputs you save. You grant Zomimo a limited license to process and store this content to provide the Service.

6. Payment and billing

Paid plans are billed monthly or annually as selected. Annual plans are non-refundable except in the first 30 days. Monthly plans may be cancelled at any time and will remain active until the end of the billing period.

All prices are in USD unless otherwise stated. Zomimo reserves the right to change pricing with 30 days' notice.

7. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. Zomimo is not liable for any losses resulting from service interruptions.

8. Limitation of liability

To the maximum extent permitted by law, Zomimo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of business, even if advised of the possibility of such damages.

Zomimo's total liability for any claim shall not exceed the amount paid by you to Zomimo in the 12 months prior to the claim.

9. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. Upon termination, your data will be retained for 30 days and then permanently deleted.

10. Changes to terms

We may update these terms from time to time. Material changes will be communicated by email with 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
